Agreement overview

This agreement contains the entire understanding between C M Photography and the client. The only way to add to or change the agreement is to do so in writing, signed by all parties. C M Photography reserves the right to update our terms and conditions at any time.


Service agreement

I agree that C M Photography will provide services to photograph the specified subject to the best of my abilities in accordance with the chosen package. All efforts will be made by C M Photography to ensure your satisfaction but any artistic interpretation by the photographer will be deemed acceptable. Every effort will be made by C M Photography to photograph all of the important moments during the session that the client has specified they would like but the photographer cannot place a unconditional guarantee on the above. If you are not satisfied with your images or prints through fault of C M Photography then the images will be re-taken and the prints replaced, if you continue to be dissatisfied then a refund will be given for the photography session and prints. Notification of the dissatisfaction must be received in writing within one week of receipt of images or prints in order to receive a refund or replacement. At

C M Photography I will do everything in my ability to ensure that you are satisfied with your images or prints but I cannot take responsibility for any dissatisfaction due to circumstances beyond my control.


Bookings

In booking your appointment or purchasing a promotion you are subject to/agree to the terms and conditions. A booking is considered confirmed after receiving the deposit. Due to the nature of the business please contact C M Photography to cancel/reschedule a booking no less than 48 hours prior to the arranged photography session date, otherwise the deposit is non- refundable. C M Photography makes every effort to book you in a date and time most convenient to you, however the booking slots are given on a first come first served basis. Please note dates and times are subject to change, C M Photography would contact you directly with any alterations to your booking.


Promotional offers/gift vouchers

Promotional offers/gift vouchers may not be used in conjunction with any other promotional offers or gift vouchers. Gift vouchers with be sent via post, if you have not received the gift voucher within one week of payment, please contact C M Photography via email/Telephone. Gift vouchers are valid for a 12-month period. Gift vouchers will only be posted within the United Kingdom.


Images and copyrights

Copyright for the images remains with C M Photography and must not be reproduced in any form without permission. However, if you purchase any image in digital format, then you are able to replicate that images as many times as you wish. The client can state how C M Photography transmits any images; these

platforms may include but not inclusive to -

• Social media platforms (including at present Instagram and Facebook/ including tagging)

• public view (studio samples/exhibitions/ CM Photography portfolio)

• CM Photography website/ online client gallery (pixieset)/Directory listings

• Buisness advertising/competition/publications


You grant the photographer full creative licence to shoot, select images, edit images and deliver them in the style and method chosen by the photographer and reflective of the style and quality advertised by the photographer.

It’s not always possible to remove snot, sleep crusts, food crumbs or dribble, please make sure everything is how you want it to look in the final images before we take any pictures.

The photographer’s choice of image selection is final. Additional editing can be requested but is delivered at the photographer’s discretion and may incur additional charges.


C M Photography allows the client to view the finished images on the online client gallery before the images are used via other platforms, so I must at that point indicate any changes in my consent for the images been used via the other platforms stated. C M Photography will complete postproduction editing on each image, this may include but not restricted to slight touch ups, contrast, lighting etc. All editing will be done in keeping with the scope of the shoot. C M Photography shall use its own judgement regarding style and postproduction input of the images. This includes but not limited to location, poses and number of images taken. All digital images are in high resolution and 300pi.

All prints ordered by the client are mounted and to the specified size, they are printed on a high-quality matt photography paper.

Allow up to 14 days after ordering for the delivery of any products. Digital images can be downloaded from the online client gallery, the download pin is given to the client once full payment has been received.

Digital images can take up to two weeks after the shoot to view on the online client gallery.


Consent

All consent forms must be completed prior to the photography shoot. Minor models – For children under the age of 18, the consent form must always be completed by the parent/legal guardian/authorised person and accompanied by the parent/legal guardian/authorised person during the shoot.


Deposit and payments

Full sessions - The client shall pay a deposit at the time of booking a full session, the booking can only be confirmed once the deposit has been paid. The deposit is required within 48 hours of making the booking to confirm. This is a non – refundable deposit in the event of cancellation less than 48 hours prior to the booking, the deposit will then be used for any loss of earning. The deposit will be refunded in full if the cancellation is over 48 hours to the booking, the refunded deposit can take up to 3 working days to be returned to you.


Full payment for the services is required on the day of the session.


Mini sessions - Payment for all mini sessions must be paid in full at the time of booking. If payment has not been received 48 hrs post booking, your slot will be released and no longer secured for you. All payments for mini session are non-refundable if you fail to attend your session.

Limit of liability

In the event of unsuitable weather conditions, or the photographer becomes ill, injured or an emergency occurs to prevent them from being able to perform the services agreed, then C M Photography will make every effort to reschedule, if for whatever reason this is not possible then the deposit received will be returned within 3 working days.


Medical

During the consultation time/completing the consent forms, clients are to disclose any medical issues/concerns (including but not exclusive to allergies, anxiety, physical disabilities etc) of any of the participants taking part (including pets) that may affect the photography shoot. Clients are to discuss any behavioural issues of any pets taking part, including but not exclusive to, any anxiety, unable to be off the lead, unable to be around other dogs, doesn’t like new people.



Health and safety on location

C M Photography will risk assess each location if on a location session prior to the session to minimise any risks, but the responsibility of health and safety remains with each adult, parent/guardian/ authorised person of child/ren and owner of pets. C M Photography takes no responsibility for health and safety of any adults, children or pets during the photography session. When taking part in a pet photography session, the owner must be present during the shoot, or a designated person who has been agreed by the client and photographer prior to the photography session, the responsibility of health and safety remains with them.

When taking part in a family/child/new-born photography shoot/event where children are present, the parent/legal guardian/authorised person/ appointed organiser of event must be present at all times during the photography session and must be over the age of 18 years, the responsibility remains with that adult.


Health and safety in the studio


Relevant risk assessments and equipment checks are carried out by C M Photography and all efforts are made by C M Photography to create a safe studio space, but each adult is responsible for their own health and safety as well as any minors present that they are parents or legal guardians to. Children are to be supervised at all times.

Fire exits and procedure is explained to clients upon arrival, clients must follow these instructions whilst in the building.


Accident or loss

The client understands and accepts the sole responsibility for their possessions and pet(s) is theirs. Any accidents or loss of items are not covered by C M Photography.

General

All parties agree to co operation and communication to gain the best possible results, this communication in the form of a consultation may be via Telephone, messages, email or in person. C M Photography cannot take any responsibility if agreed individuals fail to appear on the day of the photography shoot, cooperate during the session, or for missed images due to details not revealed to C M Photography during the consultation prior to the shoot. The location of the photography shoot will be agreed by all parties,

generally a location preferred by the subject that they are comfortable in and depending on the type of photography shoot. We reserve the right to use your photographs for promotional use. Please let us know if you do not consent when filling out your consent forms. All prices quoted are in British pounds sterling and inclusive of VAT. Each client will be given consent form to sign, The terms & Conditions and the privacy policy also available on the C M Photography website, the client must read this information and sign to say they have read it.

Complaints

At C M Photography we aim to provide high quality images for the client, if for any reason the client is dissatisfied with the images/packages/conduct of the photographer or any other concerns please feel free to contact C M Photography via email at christinem_photography@yahoo.com, where I am happy to discuss and issues/concerns and come to a resolution regarding these.
